    Until Congress enacted the FISA Amendments Act, FISA generally prohibited the government from conducting electronic surveillance without first obtaining an individualized and particularized order from the FISA court. In order to obtain a court order, the government was required to show that there was probable cause to believe that its surveillance target was an agent of a foreign government or terrorist group. It was also generally required to identify the facilities to be monitored. The FISA Amendments Act allows the government to conduct electronic surveillance without indicating to the FISA Court whom it intends to target or which facilities it intends to monitor, and without making any showing to the court—or even making an internal executive determination— that the target is a foreign agent or engaged in terrorism. The target could be a human rights activist, a media organization, a geographic region, or even a country.

    • Prohibits the individual states from investigating, sanctioning of, or requiring disclosure by complicit telecoms or other persons.
    • Permits the government not to keep records of searches, and destroy existing records (it requires them to keep the records for a period of 10 years).
    • Grants telecommunications companies immunity for cooperation with authorities –
    "Release from liability.—No cause of action shall lie in any court against any electronic communication service provider for providing any information, facilities, or assistance in accordance with [an order/request/directive issued by the Attorney General or the Director of National Intelligence]." [21]
    • Removes requirements for detailed descriptions of the nature of information or property targeted by the surveillance if the target is reasonably believed to be outside the country.[21]
    • Increased the time for warrantless surveillance from 48 hours to 7 days, if the FISA court is notified and receives an application, specific officials sign the emergency notification, and relates to an American located outside of the United States with probable cause they are an agent of a foreign power. After 7 days, if the court denies or does not review the application, the information obtained cannot be offered as evidence. If the United States Attorney General believes the information shows threat of death or bodily harm, they can try to offer the information as evidence in future proceedings.[22]
    • Permits the Director of National Intelligence and the Attorney General to jointly authorize warrantless electronic surveillance, for one-year periods, targeted at a foreigner who is abroad. This provision will sunset on December 31, 2012.
    • Requires FISA court permission to target wiretaps at Americans who are overseas.
    • Requires government agencies to cease warranted surveillance of a targeted American who is abroad if said person enters the United States. (However, said surveillance may resume if it is reasonably believed that the person has left the States.)
    • Prohibits targeting a foreigner to eavesdrop on an American's calls or e-mails without court approval.[23]
    • Allows the FISA court 30 days to review existing but expiring surveillance orders before renewing them.
    • Allows eavesdropping in emergencies without court approval, provided the government files required papers within a week.
    • Prohibits the government from invoking war powers or other authorities to supersede surveillance rules in the future.
    • Requires the Inspectors General of all intelligence agencies involved in the President's Surveillance Program to "complete a comprehensive review" and report within one year

    This is the kind of comedic situation that Russians find hilarious. I mean, sure it’s plenty bad and all that, PRISM, XKeyScore, show trials, surveillance, threats to what’s left of journalism, sure, I get all that, I’m properly concerned. None of that stops it from being hilarious.
    Few geopolitical situations can ever give the Russians a full, free, rib-busting belly laugh. This one sure does.

    The authorities finally got around to convicting Bradley this week, of some randomized set of largely irrelevant charges. But the damage there is already done; some to Bradley himself, but mostly grave, lasting damage to the authorities. By maltreating Bradley as their Guantanamo voodoo creature, their mystic hacker terror beast from AlQaedaville, Oklahoma, they made Bradley Manning fifty feet high.
    At least they didn’t manage to kill him. Bradley’s visibly still on his feet, and was not so maddened by the torment of his solitary confinement that he’s reduced to paste. So he’s going to jail as an anti-war martyr, but time will pass. Someday, some new entity, someone in power who’s not directly embarrassed by Cablegate, can pardon him.

    More astonishing yet: this guy Assange, and his tiny corps of hacker myrmidons, actually managed to keep Edward Snowden out of US custody. Not only did Assange find an effective bolthole for himself, he also faked one up on the fly for this younger guy.
    It’s incredible to me that, among the eight zillion civil society groups on the planet that hate and fear spooks and police spies, not one of them could offer Snowden one shred of practical help, except for Wikileaks. This valiant service came from Julian Assange, a dude who can’t even pack his own suitcase without having a fit.

    Snowden told the truth to the public — but then again, so did Solzhenitsyn, and even Al Gore lets on sometimes. The truth doesn’t do the trick for anybody, the truth is just a complicating factor. The present geopolitical situation is absolutely cluttered with amazing lies that didn’t work out for their owners.
    The Iraqi weapons of mass destruction never existed. Climate change does exist, and could drown Wall Street any day now. The abject state of global finance is obvious, yet it makes no difference to the ongoing depredations. Drones are stark assassination machines, and they don’t stay classified. Anyone could go on.
    And, yeah, by the way, Microsoft, Apple, Cisco, Google et al, they are all the blood brothers of Huawei in China — because they are intelligence assets posing as commercial operations. They are surveillance marketers.

    Вы думаете что Американский век постепенно закончится к году 2050? И не надейтесь - более правильная дата 2025 год, и падение будет таким же катастрофическим как и падение прочих империй Нового Времени.

    It’s 11:59 p.m. on Thanksgiving Thursday in 2025. While cyber-shoppers pound the portals of Best Buy for deep discounts on the latest home electronics from China, U.S. Air Force technicians at the Space Surveillance Telescope (SST) on Maui choke on their coffee as their panoramic screens suddenly blip to black. Thousands of miles away at the U.S. CyberCommand’s operations center in Texas, cyberwarriors soon detect malicious binaries that, though fired anonymously, show the distinctive digital fingerprints of China’s People’s Liberation Army.
    The first overt strike is one nobody predicted. Chinese “malware” seizes control of the robotics aboard an unmanned solar-powered U.S. “Vulture” drone as it flies at 70,000 feet over the Tsushima Strait between Korea and Japan. It suddenly fires all the rocket pods beneath its enormous 400-foot wingspan, sending dozens of lethal missiles plunging harmlessly into the Yellow Sea, effectively disarming this formidable weapon.
    Determined to fight fire with fire, the White House authorizes a retaliatory strike. Confident that its F-6 “Fractionated, Free-Flying” satellite system is impenetrable, Air Force commanders in California transmit robotic codes to the flotilla of X-37B space drones orbiting 250 miles above the Earth, ordering them to launch their “Triple Terminator” missiles at China’s 35 satellites. Zero response. In near panic, the Air Force launches itsFalcon Hypersonic Cruise Vehicle into an arc 100 miles above the Pacific Ocean and then, just 20 minutes later, sends the computer codes to fire missiles at seven Chinese satellites in nearby orbits. The launch codes are suddenly inoperative.
    As the Chinese virus spreads uncontrollably through the F-6 satellite architecture, while those second-rate U.S. supercomputers fail to crack the malware’s devilishly complex code, GPS signals crucial to the navigation of U.S. ships and aircraft worldwide are compromised. Carrier fleets begin steaming in circles in the mid-Pacific. Fighter squadrons are grounded. Reaper drones fly aimlessly toward the horizon, crashing when their fuel is exhausted. Suddenly, the United States loses what the U.S. Air Force has long called “the ultimate high ground”: space. Within hours, the military power that had dominated the globe for nearly a century has been defeated in World War III without a single human casualty.

    Хорошо, исправлюсь :)

    Но при существовании Гугель-переводчика (несмотря на все его недостатки), получить первое представление о приведенных отрывках вполне можно без литературного перевода. А там уж, при наличии интереса, можно и литературно перевести то что не понятно. Вот такая линия ленивых мыслей :)

    При всем уважении, гугл-переводчик часто дает абракадабру на выходе. В качестве компромисса могу предложить такой вариант - длинные цитаты если не переводить, то хотя бы кратко передавать содержание. :)

    Ладно, кое-какие кусочки:

    Это именно та комедийная ситуация которая особенно смешна для России. Я, конечно, понимаю что ничего хорошего в этом нет - PRISM, XKeyScore, показательные суды, всеобщее наблюдение, угрозы в адрес того что осталось от журналистики, и я этим обеспокоен. Но это не мешает этой ситуации быть весьма смешной. Мало какие геополитические ситуации могут дать повод России для несдержанного, сотрясающего живот, вольного смеха. Эта история - несомненно дает.

    К примеру возьмем такого диссидента как Андрей Сахаров. Такой полезный, скромный, культурный, умный парень, который сделал Вам водородную бомбу. Это жуткое устройство прямо из преисподней еще и работает, так что все прекрасно. Потом вдруг он слетает с катушек: Знаете что? Благородная наука физики не должна вредить Человечеству!
    Что за эгоистический, глупый жест? Слушай сюда, Доктор Лабораторный Халат: По какой другой причине все эти государственные деньги были вам даны, кроме как не для нанесения "вреда человечеству"? Если бы физика была бы безвредной у Вас бы не было зарплаты!
    Точно также чувствует НСА сейчас. Это те же самые ботинки которые надел Сноуден на ноги НСА. Эсли ты в НСА, как и прочие тысячи сотрудников, ты с самого начала знаешь что кабеля опутавшие планету это средство массового шпионажа. Потому что это их изначальная функция!

    Власти наконец-то снизошли до принесения приговора Брэдли в эту неделю, по ряду случайных и в основном не относящихся к делу обвинений. Но ущерб уже нанесен; частично самому Брэдли, но наиболее значительный, долгоиграющий ущерб для самих властей. Относясь к нему как к Гунтамовской вуду-кукле, воплощающей абстрактный хакерско-ткррористический образ из АлКайдавиля в Оклахоме, они превратили Брэдли Мэнинга в гиганта ростом 20 метров.
    Но по крайней мере они не убили его. Брэдли на своих ногах, и не сошел с ума в карцере, и он пойдет в тюрьму как мученик анти-военного движения. В одно прекрасное время, кто-то у власти, кто не замешан в Кабельгейте, может его амнистировать.

    Что более удивительно: этот парень Асандж и его скромная армия хакерных хомячков реально смогла охранить Эдварда Сноудена от госмашины США. Асандж не только нашел эффективную норку для себя, но и сумел по ходу создать такую же для своего молодого коллеги.
    Что меня поражает так то что среди восьми зиллионов общественных групп на планете, которые боятся и ненавидят стукачей и полицейских шпионов, ни одна не смогла предложить и кусочка практической помощи Сноудену, кроме Викиликс.

    Сноуден рассказал правду публике - но также и Солженицин, и даже Ал Гор говорит ее иногда. Правда не всегда и не всем нужна, она просто усложняет жизнь. Современная геополитическая ситуация абсолютно загромождена удивительными обманами которые так и не сработали для своих авторов.
    Средства Массового Поражения в Ираке так и не нашлись. Изменение Климата существует и может затопить Волл Стрит вскоре. Печальное состояние мировых финансов очевидно, что не останавливает продолжающийся грабеж. Дроны это абсолютные машины убийства, и это больше не секрет. Любой может продолжить этот список.
    И, да, между прочим, Microsoft, Apple, Cisco, Google это все кровные братья Китайскому Huawei - потому что они филиалы разведорганизаций законспирированных под коммерческие фирмы.

    Так что правда всем известна, но никто не собирается вычистить все остальное обилие лжи. Не видно реального способа избавиться от гиганской продолжающейся институционной лжи. Не существует механизма который бы обеспечил бы честное поведение. Это как уничтожить многоженство в Османской Империи.

    Компьютеры были изобретены для крипто, шпионских и контролирующих программ. Это то чем как раз Алан Тьюринг и занимался. Это область откуда произошла кибернетика, это ее изначальный грех и ее отравленное яблоко. Не существует ни одной силы на Земле желающей на полном серьезе заткнуть бутылку, только предотвратить то чтобы другие к ней прикладывались, и только хотят наклеить свою респектабельную этикетку на нее.

    Посмотрев на этот выбор маркетинга, возникает вопрос что выбор этих обложек демонстрирует: состояние Американского общества или состояние журнализма?

    Я боюсь ответа на этот вопрос.

    Со временем мы свыкнемся с тем что после странного поиска в Гугле к нам в гости может нагрянуть полиция, что грубая шутка в Фэйсбуке приведет к аресту или увольнению, что некоторые высказывания по телефону приведут к тому что вы будете занесены в черный список запрещенных к полетам, что подозрительные разговоры будут записаны ближайшими Гугл-Очками. Также, со временем, вы привыкнете сами себя контролировать чтобы не сказать чего-нибудь странного, не говорить острых шуток, не думать сильно далеко вне пределов допустимых рамок. Вы научитесь автоматически подавлять ту сумасшедшую, безответственную часть мозга которая по совпадению ответственна за человеческую креативность.

    Конечно же противоречивый комментарий не приведет вас в Гулаг. Может быть вы проведете из-за него день в перегретой комнате для допросов и ваш компьютер будет изьят на несколько месяцев. Только небольшое напоминание о том что надо думать что дозволено сказать и думать - в любой момент времени. Вовсе нет необходимости бросить вас в тюрьму, достаточно вас помытарить чтобы в следующий раз вы об этом не забыли. И тот Огонь, который делает нас Людьми, немного пригаснет, и вы только пожмете плечами - Что ж делать? В конце конов мы живем в Пост-9/11 Мире.

    Прекрасно, прекрасно. НСА сливает в Израиль _всю_ информацию которую оно получает из своих глобальных сетей, даже о гражданах и резидентах США на слежку за которыми нет ордера. В то время как ЦРУ и ФРБ получает от НСА отредактированную информацию (критерии же минимизации информации, правда, засекречены).

    How would we report on the government shutdown if it were happening in another country?

    With hours remaining until the government of the world’s richest nation runs out of money, attention now focuses on longtime opposition leader John Boehner, under pressure from both the regime and the radical elements of his own movement, who may be the only political figure with the standing needed to end the standoff.
    While the country’s most recent elections were generally considered to be free and fair (despite threats against international observers), the current crisis has raised questions in the international community about the regime’s ability to govern this complex nation of 300 million people, not to mention its vast stockpiles of weapons of mass destruction.

    Как бы наша пресса писала об "выключении правительства" если бы это случилось бы в другой стране?

    Теперь, когда остается несколько часов до того как у правительства богатейшего в мире государства закончатся деньги, внимание приковано к испытанному лидеру оппозиции Джону Бонеру, который находится под давлением как и самого режима так и радикальных элементов в своем движении, и кто может быть является единственной фигурой могущей прекратить противостояние.
    Хотя последние выборы в стране в общем-то воспринимаются населением как свободные и честные (несмотря на угрозы международным наблюдателям), теперешний кризис заставил общество задуматься о способности правительства управлять таким разнообразным населением в 300 миллионов, не говоря уже способности контролировать свои огромные запасы оружия массового поражения.

    AUSTIN (CN) - The Texas attorney general warned the Organization for Security and Co-operation in Europe that its election observers could be arrested and criminally charged if they come within 100 feet of a polling place on Election Day.

    Генеральный прокурор Техаса предупредил ОБСЕ что их наблюдатели за выборами могут быть арестованы и им предьявят уголовные обвинения если они приблизятся к избирательным участкам на расстояние меньше 100 футов в День Выборов.

    В свете же Сноудоновских откровений про хакерские возможности НСА все эти людские манипуляции с бюллетенями кажутся детскими игрушками, когда можно просто повзламывать выборную компьютерную систему.

    С другой стороны нужна ли эта древняя формальная процедура выборов если спецслужбы могут просто в почти реальном времени мониторить общественные сентименты? Так пусть это и делают легально, будучи частью глобальной системы прямой кибер-демократии, о чем давно говорили советские писатели-фантасты в своих коммунистических утопиях :)

When you have that view about your religion, it's a very small step to applying the same schema to politics. You think there are good and evil leaders in the world, good and evil regimes in the world. And this is a very different concept than the concepts that many cultures and many other peoples have.

    ...That firm, of which John Foster Dulles was the managing partner for decades and where Allen also worked, had a specialty. The specialty was pressuring small and weak countries to accept rules, laws, regulations that made it easy for American corporations to operate in those countries.

    ...They began to identify the interests of large American multinational corporations with the interests of the United States. By the time they got into power, they saw no difference between the two, and in fact this was really the number one way that they decided which countries were good and which countries were evil.

    The good ones were the ones that gave free rein to American corporations. The evil ones were the ones that sought to tax or restrict or regulate or otherwise bother foreign capital. They carried that view into office, and the monsters they set out to destroy were all people who wished to regulate the freedom of American capital to operate in their countries. That was a cardinal sin in the eyes of the Dulles brothers.

    Братья начали воспринимать интересы крупных Американских корпораций как идентичных с интересами США. К тому времени когда они получили власть они не видели разницы между этими интересами. И это воззрение они принесли в госкабинеты, и монстры, которых они рашили уничтожить, были всеми теми людьми которые хотели регулировать и ограничить свободу Американского капитала в своих странах. И это был смертный грех в глазах братьев.

    Они (братья Даллесы) достигли успеха в свержении правительства Ирана и Гватемалы потому что это были демократические общества. Это были открытые общества. В них была свободная пресса. В них были разнообразные независимые организации. В них были профессиональные обьединения. В них были профсоюзы. В них были студенческие общества. В них были религиозные организации. Когда вы имеете отрытое общество очень легко с помощью секретных операций проникнуть в него и коррумпировать его.

    Так получилось что одним из свидетелей того что случилось в Гватемале во время переворота был молодой Аргентинский врач Че Гевара. Позже Че Гевара попал в Мексику где встретился с Фиделем Кастро. Кастро спрашивал его: Что случилось в Гватемале? Он был очень озадачен и обеспокоен. Они провели много часов обсуждая эту тему, и Че Гевара рассказал ему то о чем я только что говорил: ЦРУ удалось достичь успеха потому что в Гватемале было открытое общество. И в этот момент они решили что если они прийдут к власти на Кубе, они не смогут позволить себе демократию. Это должен быть диктаторский режим. Никакой свободной прессы, независимых организаций, потому что иначе ЦРУ сможет свергнуть их. И во время речи которую Фидель произнес после прихода к власти он сказал что Куба не повторит судьбу Гватемалы.

    They were able to succeed in Iran and Guatemala because those were democratic societies. They were open societies. They had free press. There were all kinds of independent organizations. There were professional groups. There were labor unions. There were student groups. There were religious organizations. When you have an open society, it's very easy for covert operatives to penetrate that society and corrupt it.

    Actually, one of the people who happened to be in Guatemala at the time of the coup there was the young Argentine physician Che Guevara. Later on, Che Guevara made his way to Mexico and he met Fidel Castro. Castro asked him: What happened in Guatemala? He was fascinated. They spent long hours talking about it, and Che Guevara reported to him what I just said: The CIA was able to succeed because this was an open society. It was at that moment that they decided: If we take over in Cuba, we can't allow democracy. We have to have a dictatorship. No free press, no independent organizations, because otherwise, the CIA will come in and overthrow us. And, in fact, Castro made a speech after taking power with Arbenz sitting right next to him, and said: Cuba will not be like Guatemala.
